Australia Advances Privacy Overhaul to Address Rising AI and Data Challenges

In response to the increasing use of artificial intelligence, facial recognition, and connected devices, Australia is proposing significant amendments to its privacy laws aimed at enhancing the protection of personal information. A central feature of these reforms is the introduction of a fair and reasonable test that mandates organizations to provide justification for the collection and usage of personal data. Another key proposal empowers individuals with a stronger right to demand the deletion of their personal information held by major digital platforms and establishes more stringent requirements for obtaining meaningful consent.

The Australian government is also pushing for more robust protections concerning the use of personal data in targeted advertising, data trading, and activities involving artificial intelligence. These measures are designed to grant Australians greater control over how their information is collected, utilized, and distributed. Public demand for these changes is evident, with government research indicating strong support for increased personal data control and the legal ability to request data deletion.

Facial recognition technology is another focal point of the proposed reforms, especially as its use in public spaces, such as retail environments, faces heightened regulatory scrutiny. The government is addressing these concerns by incorporating provisions that regulate the deployment of biometric information, thereby aiming to safeguard individual privacy in publicly accessible areas.

Currently, the government is soliciting input on these legislative proposals, with the consultation period open until September 18, 2026.
